Conditions attached
- Local Law 18 of 2022: hosts must register with the Mayor's Office of Special Enforcement (OSE). Only host-present rentals are allowed: host must be a natural person and permanent occupant, stay in the same unit as guests, and have no more than two paying guests. Whole-home rentals under 30 days are effectively prohibited (OSE FAQ: you cannot rent out an entire apartment or home to visitors for less than 30 days). Registration not allowed for NYCHA, rent-controlled, rent-stabilized or SRO units, buildings on OSE's Prohibited Buildings List, or where a lease bars STRs; tenants' landlords are notified. Registration term is four years (Rules 21-05). Booking platforms may not process unregistered listings. Non-owner-occupied whole-home fee distinction: not applicable because such rentals cannot be registered. In addition to sales tax, a NYC unit fee of $1.50 per unit per day applies (tax.ny.gov, Schedule N).
